Enduring Power of Attorney for property – this person/people can keep your affairs in order, pay bills, manage bank accounts, look after property if you are no longer able to.
Enduring Power of Attorney for personal care and welfare – relates to health and wellbeing e.g. if you are no longer able to, this person can make decisions around treatment, medication and can help if needing to move into a rest home.
Your Enduring Power of Attorney has a legal requirement to consult with you when possible. You can cancel or amend your enduring EPA provided you have mental capacity.
If you don’t have an EPA setup and there comes a time where you do need one – an application would need to go to Family Court for an order. The court may appoint a relative, Social Worker, Doctor, or even a Manager of a care facility in the position, this way is time consuming and costly and it may not be someone that you would want – it is better to have an EPA in place than not!
